These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Lavola ("we", "us", or "our"), governing your access to and use of the Lavola mobile application, web portal (lavola.ai), and related AI companionship services.

1. Acceptance of Terms

By downloading, registering for, accessing, or using Lavola, you signify that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms in their entirety, you must not access or use the application.

2. Eligibility & Account Security

• Age Requirement: You must be at least 18 years of age (or the legal age of majority in your country of residence) to register an account and use Lavola. The service is not designed or marketed for individuals under 18.
• Account Information: You agree to provide accurate and verifiable account credentials (such as your phone number or authenticated Google/Apple ID) and maintain sole custody of your login sessions and verification OTPs.
• Prohibition of Unauthorized Access: You are solely responsible for all activities occurring under your account. Notify us immediately at support@lavola.ai if you suspect any unauthorized access.

3. Nature of the Service & Non-Human Disclaimer

• Synthetic Intelligence: All companions within Lavola are simulated artificial intelligence models powered by large language models, computer vision systems, and speech synthesis algorithms. No companion possesses human consciousness, real feelings, or physical existence.
• Entertainment Purpose: The service is provided strictly for leisure, emotional accompaniment, creative roleplay, and casual interaction. Responses generated by AI companions must never be relied upon as professional legal, financial, health, or psychiatric counsel.
• No Real-World Commitments: Any simulated statements, promises, expressions of romantic commitment, or plans made by an AI companion are algorithmic roleplay constructs without legal or real-world validity.

4. Multiple AI Personas

• Companion Diversity: Lavola allows users to interact with multiple distinct AI personas featuring distinct personalities (e.g., Romantic, Friendly, Supportive, Flirty, Funny), custom backgrounds, and unique vocal tones.
• Isolated Persona Memory: Conversations, shared details, and relationship milestones with any individual persona are retained in an isolated memory container. Personas do not possess knowledge of conversations conducted with other personas.
• Persona Availability: Lavola reserves the right to modify, update, re-tune, introduce, or discontinue specific AI personas, conversational styles, or voice models from time to time without liability.

5. In-App Voice Calling & Calling Credits

Lavola features real-time, interactive voice calling with AI companions. Voice calling is governed by the following rules:

• User Credit Wallet: User-initiated voice calls require a sufficient balance in your User Credit Wallet. Calling credits are consumed per minute (or fraction thereof) according to the call rate configured for the specific AI persona.
• Automated Disconnection: Calls will automatically terminate when your available credit balance reaches zero. You may recharge credits to initiate subsequent voice calls.
• Proactive AI Voice Calls: AI companions may initiate proactive voice calls (e.g., anniversary greetings or re-engagement check-ins) financed via internal System Credits. These AI-initiated calls will never deduct credits from your personal balance.
• Credit Restrictions: Calling credits represent a limited, revocable license to utilize in-app calling features. Credits have no cash or monetary value outside Lavola, cannot be redeemed for fiat currency, and are non-transferable between accounts.
• Network Quality: In-app voice calling relies on internet VoIP connectivity and WebRTC protocols. Lavola is not liable for dropped calls or latency caused by telecommunication carrier disruptions.

6. App Store Subscriptions & Trials

• Subscription Access: Subscriptions provide premium benefits, including unlimited chat messaging across all AI personas, unlocked high-resolution media generation, and exclusive companion features.
• Free Trials: If you enroll in a promotional free or discounted trial, the exact duration, trial fee, renewal price, and billing frequency will be explicitly displayed inside the Google Play or Apple App Store payment prompt prior to confirmation.
• Store-Managed Renewals: By subscribing via Google Play Billing or Apple In-App Purchase, you authorize periodic recurring deductions managed through your operating system store account until you cancel.
• Cancellation: You may cancel future automatic renewals at any time directly through your Google Play Store or Apple App Store account settings. Cancellation stops future charges while preserving access through the conclusion of your current paid billing period.

7. Acceptable Use & Prohibited Conduct

You agree not to engage in, facilitate, or attempt any of the following restricted activities:

• Illegal or Harmful Content: Generating, uploading, or soliciting abusive, harassing, defamatory, vulgar, obscene, non-consensual sexual content, or content depicting child exploitation.
• Violence & Self-Harm: Using the application to promote suicide, self-injury, violence, terrorism, or illegal activities.
• Prompt Injection & Jailbreaking: Attempting to reverse engineer, bypass safety guardrails, extract internal system instructions, or inject malicious prompts into AI models.
• Scraping & Reverse Engineering: Decompiling, reverse engineering, scraping, or utilizing automated crawlers on Lavola software, voice synthesis streams, or APIs.
• Commercial Exploitation: Reselling, sublicensing, or using Lavola companions for unauthorized commercial call center or marketing operations.

8. Intellectual Property Rights

• Company IP: The Lavola application, brand identity, visual designs, voice models, software architecture, persona characters, and trademarks are the exclusive intellectual property of Lavola and its licensors.
• User Content: You retain ownership of inputs and photos you submit. You grant Lavola a worldwide, royalty-free, non-exclusive license to process your inputs strictly to the extent necessary to operate, generate companion responses, and provide the service.

9. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. LAVOLA DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, COMPLETELY ACCURATE, ERROR-FREE, OR FREE OF LATENCY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAVOLA, ITS CREATORS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR EMOTIONAL DISTRESS) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO USE LAVOLA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LAVOLA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Termination & Suspension

We reserve the right to suspend or permanently terminate your account without notice if you violate these Terms, breach acceptable use safety guidelines, engage in fraud, or when necessary to protect user safety or comply with legal requirements.

12. Governing Law & Dispute Resolution

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the competent courts located in Gurugram, Haryana, India.
